These types of relative adoptions occur when the spouse of a biological parent wishes to adopt the child(ren) of the biological parent they are married to. In this case, unlike all others, the parental rights of the biological parent to whom the step parent is married does not have to be terminated. However all other legal and biological parent’s rights must be terminated.
The good news is that as a relative adoption the Judge may waive the requirement for a home study and the requirement that the adoptive parents have physical custody of the child(ren).
